The General Contractor on the project was made up of a committee elected by the Board of Trustees at the religious organization that was building the new facility. The subcontractor that the welder worked for had previously agreed under contract with the committee that certain safety requirements would need to be updated prior to work being started. The committee denies that conversations about such safety issues ever took place.

The lack of achieving those safety requirements before the employed Plaintiff began work on the construction site directly led to the increased severity of The Plaintiff’s injuries. Thorough research by Yonke Law into the regulations set forth by the Occupational Safety and Health Administration (OSHA) showed that the subcontractor and the committee acting as the general contractor were jointly responsible for safety on the construction site. This led to the settlement in the case.
